Social media startup Fij Grocery delivery is partially sued for giant Instacart and party planning app trademark violations, the company announced on Thursday. Earlier this week, Estacart launched a new drink and snack delivery app for parties called Fizh and announced that Partful had integrated Fij directly into its platform.

Established in 2020, Fizz is a gene Z-centered social networking app available in over 400 college complexes.

The suit, filed in the US District Court for the northern district of California on Wednesday, uses the name “Fiz” in relation to social or event planning services, and partially a jury trial, prohibitory relief, loss, and a court order seeks.

Instacart and Partifull did not respond to Techcrunch’s request for comments.

In the trial, Fiz said that it has been using the “Fiz” trademark since January 2022 and has been filed for trademark registration in December 2021. Startup is accusing instaccart and violating the common law trademark violations, federal trademark violations, cybercattings, and improper competition laws of California.

The case reads, “This new Fizh app by Instacart and Partful is an attempt to misbehave in a wrong way that the plaintiff has developed manifold through the continuous use of Fiz Marx between General-Z demographic.” “Together, Instacc and Partful General-Z are competing with the plaintiff in their main market of event planning for demographic. Instacc and Partful could have selected any name for their new venture, but instead of competing on a single playground, they are using Fizz.”

Fiz alleged that Instacart and Partful deliberately launched a new app with the same name for the same gene Z demographic, which created a possibility of confusion among the customers, which could assume that the new ordering service has been affiliated or supported by FIz.

The startup also alleged that Instacc and Partful General Z are exploiting their brand recognition as a known social platform for Z.

“The plaintiff is informed and agreed and then alleged that Defenders Instacart had a bad belief for profit from Fiz Marx on entering the domain name. “It is said in the trial.” In particular, the defendant Instacart knew or know about the Fiz Marx and its domain name should include the plaintiff and trade name of the plaintiff. In doing this, defendant Instacart intended to remove consumers from the online location of the Fizh platform Fij app online location for the defendant’s own commercial advantage. ,

Additionally, the trial has been alleged that the event competes with Fizer directly in the planning space, and that the company is now using the name of Fiz, which is after confusing the General Z demographic “after confusing the General Z.” through the Fair competition to win the General Z. Market through the Fair competition.

The announcement announced today is not the first brush of Fizer with legal action, as the startup sued rival Sidchat on unfair competition practices in 2023.
